End User License Agreement

This End User License Agreement (“EULA”) is a legal agreement between you (“User,” “you,” or “your”) and Axiom Fitness LLC (“Axiom Fitness,” “Orum Training,” “we,” “our,” or “us”) governing your use of the Orum Training mobile application, website, and related services (collectively, the “App”).

 

By downloading, installing, accessing, or using the App, you agree to be bound by this EULA.

 

If you do not agree to this EULA, do not install or use the App.

1. License Grant

 

Subject to your compliance with this EULA and our Terms of Service, Axiom Fitness LLC grants you a limited, non-exclusive, non-transferable, revocable license to:

 

  • Download and use the App

  • Access your account

  • Use the App’s features for personal, non-commercial purposes

 

This license does not transfer ownership of the App or any intellectual property rights.

2. Restrictions

 

You may not:

 

  • Copy, reproduce, or distribute the App

  • Reverse engineer, decompile, or attempt to access source code

  • Modify or create derivative works of the App

  • Circumvent security measures

  • Rent, lease, sublicense, or resell access to the App

  • Use automated tools, bots, or scraping software without permission

  • Use the App in violation of applicable laws

 

Any unauthorized use may result in immediate termination of this license.

3. Ownership

 

The App and all associated software, designs, graphics, trademarks, logos, and content owned by Axiom Fitness LLC remain the exclusive property of Axiom Fitness LLC and its licensors.

 

All rights not expressly granted under this EULA are reserved.

4. User Accounts

 

Certain features require account registration.

 

You are responsible for:

 

  • Maintaining account security

  • Protecting login credentials

  • Activities occurring under your account

 

You must provide accurate information and keep your account information current.

 

​

5. User Content

 

Users may upload content including:

 

  • Workout programs

  • Photos

  • Videos

  • Posts

  • Comments

  • Messages

 

You retain ownership of your content.

 

By uploading content, you grant Orum Training a non-exclusive, royalty-free license to host, display, store, reproduce, and distribute such content solely for operation of the App and related services.

6. Third-Party Services

 

The App may integrate with third-party services, including:

 

  • ⁠Apple Health

  • ⁠Google Health Connect

  • ⁠Firebase

  • ⁠Stripe

  • ⁠Apple App Store

  • ⁠Google Play

 

Your use of third-party services is governed by their respective terms and privacy policies.

7. Updates

 

We may provide updates, patches, bug fixes, feature enhancements, or modifications to the App.

 

You agree that such updates may be installed automatically where permitted by your device settings.

 

We are not obligated to provide updates or continue supporting any version of the App.

8. Availability

 

We may modify, suspend, discontinue, or remove features of the App at any time without liability.

 

We do not guarantee uninterrupted availability of the App or any specific feature.

9. Disclaimer of Warranties

 

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE.”

 

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AXIOM FITNESS LLC DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING:

 

  • MERCHANTABILITY

  • FITNESS FOR A PARTICULAR PURPOSE

  • NON-INFRINGEMENT

  • ACCURACY

  • RELIABILITY

  • AVAILABILITY

 

YOUR USE OF THE APP IS AT YOUR OWN RISK.

10. Limitation of Liability

 

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AXIOM FITNESS LLC SHALL NOT BE LIABLE FOR:

 

  • LOST PROFITS

  • LOST DATA

  • SERVICE INTERRUPTIONS

  • FITNESS OR HEALTH OUTCOMES

  • USER-GENERATED CONTENT

  • MARKETPLACE DISPUTES

  • INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES

 

REGARDLESS OF THE LEGAL THEORY ASSERTED.

11. Termination

 

This license automatically terminates if you violate this EULA.

 

We may suspend or terminate your access to the App at any time for violations of this EULA, our Terms of Service, or applicable law.

 

Upon termination, you must cease use of the App.

12. Apple App Store Additional Terms

 

If you obtained the App through the Apple App Store:

 

  • Apple is not a party to this EULA.

  • Apple has no obligation to provide maintenance or support services for the App.

  • Apple is not responsible for claims relating to the App, including product liability claims, legal compliance claims, or consumer protection claims.

  • Apple and its subsidiaries are third-party beneficiaries of this EULA and may enforce its terms.

13. Governing Law

 

This EULA shall be governed by and interpreted under the laws of the State of Missouri, without regard to conflict of law principles.

 

Any legal action arising from this EULA shall be brought exclusively in the state or federal courts located within Missouri.

 

You consent to the jurisdiction of those courts.

 

​

14. Entire Agreement

 

This EULA, together with the Privacy Policy and Terms of Service, constitutes the entire agreement between you and Axiom Fitness LLC regarding use of the App.
